User Agreement

Welcome to MusixAI, a zero-threshold AI music generation application dedicated to providing you with a convenient, efficient, and high-quality AI music creation experience. This User Agreement (hereinafter referred to as the "Agreement") is a legal agreement between you (hereinafter referred to as "User") and MusixAI (hereinafter referred to as "We") regarding your use of the MusixAI application and related services. By downloading, installing, or using MusixAI, you acknowledge that you have read, understood, and fully agreed to all the terms and conditions of this Agreement. If you do not agree to any part of this Agreement, please stop downloading, installing, or using MusixAI immediately.

This Agreement is formulated based on the core features of MusixAI, including zero-account login, AI music generation, style customization, work management, playback, download, and in-app purchase services. It aims to clarify the rights and obligations between you and us during your use of the services, ensure the smooth operation of the application, and protect the legitimate rights and interests of both parties. Please read this Agreement carefully before using the services, as your continued use of MusixAI will be deemed as your acceptance of all the terms of this Agreement.

1. General Provisions

1.1 Purpose of the Agreement

This Agreement regulates the relationship between you and us when you use MusixAI and its related services. It defines the rights and obligations of both parties, the scope of services provided by us, the rules for your use of the services, and the handling of related issues, so as to ensure that both parties can use and provide services in a standardized and orderly manner.

1.2 Scope of Application

This Agreement applies to all users who download, install, and use MusixAI, including users who use the free basic services and users who purchase premium services through in-app purchases. All your behaviors in using MusixAI and its related services shall be subject to the provisions of this Agreement. If there are special rules for specific services (such as in-app purchase services), such special rules shall prevail; if there are no special rules, this Agreement shall apply.

1.3 Zero-Account Login

MusixAI adopts a zero-account login mode, which means you do not need to register an account, provide personal identification information (such as name, phone number, email address), or log in with any third-party accounts to use the core services of the application. You can directly open the app and use basic features such as AI music generation, style customization, mood adjustment, voice setting, music playback, download, and work management. We will not collect any personal identification information from you due to the zero-account login mode, ensuring that you can use the services with greater privacy and freedom.

2. Services Provided by Us

We are committed to providing you with stable, high-quality AI music generation and related services, and continuously optimizing and upgrading the services according to user needs and technological development. The specific services provided by us include but are not limited to the following:

2.1 Basic Free Services

All users can use the following free basic services without account registration or payment:

• AI Music Generation: You can input text descriptions (including music style, mood, theme, vocal requirements, etc.) to guide the AI to generate original music that meets your expectations. The generated music will be stored in the app for your management and use.
• Customization Features: You can customize the style (such as pop, rock, classical, electronic, etc.), mood (such as happy, sad, calm, exciting, etc.), and vocal style (such as male voice, female voice, child voice, etc.) of the generated music to meet your personalized needs.
• Work Management: You can view, play, rename, and delete the music works you have generated, and manage your playback history and download records for easy retrieval and use at any time.
• Music Playback and Download: You can play the generated music online, and download the music to your local device for offline playback (subject to the limitations of free services, such as audio quality).

2.2 Premium Paid Services

We provide premium paid services through in-app purchases to meet your higher-demand music creation and use needs. The specific premium services include but are not limited to high-quality music download (such as lossless audio format), unlimited music generation, exclusive vocal styles, ad-free experience, and priority technical support. The specific content, price, and validity period of the premium services will be displayed on the in-app purchase page, and you can choose to purchase according to your own needs.

When you purchase premium services, you will complete the payment through the third-party payment platform (such as Apple App Store or Google Play) designated by us. The payment platform will handle the payment process, and we will activate the corresponding premium services for you after confirming the successful payment. The transaction information (such as purchase amount, purchase time, and type of purchased service) will be recorded for after-purchase verification and support.

2.3 Service Optimization and Update

We will continuously optimize the AI music generation algorithm, improve the stability and functionality of the app, and add new features and services according to user feedback and technological progress. We may update the app through automatic updates or prompt you to update manually. You can choose to update the app to experience the latest services; if you do not update, some new features may not be available, and the stability of the existing services may be affected.

2.4 Service Limitations

To ensure the normal operation of the services and the experience of all users, we may set reasonable limitations on the use of the services, including but not limited to the number of music generations per day for free users, the audio quality of downloaded music, and the storage space for works. The specific limitations will be displayed in the app, and we may adjust them according to the operation situation and user needs. We will notify you of any major adjustments through in-app prompts.

3. Your Rights and Obligations

3.1 Your Rights

• Right to Use Services: You have the right to use the basic free services provided by MusixAI free of charge, and to purchase and use premium paid services according to your own needs.
• Right to Personalize Customization: You have the right to customize the style, mood, and vocal style of the generated music according to your preferences, and to manage your generated works freely (such as viewing, playing, downloading, renaming, deleting, etc.).
• Right to Feedback: You have the right to provide feedback, suggestions, or complaints about MusixAI and its services to us. We will carefully listen to your opinions and continuously improve the services.
• Right to Terminate Use: You have the right to stop using MusixAI and its services at any time by uninstalling the app. Terminating the use will not affect the works you have downloaded to your local device, but you will no longer be able to use the app's online services (such as music generation, cloud storage of works, etc.).

3.2 Your Obligations

• Abide by the Agreement: You shall abide by all the terms and conditions of this Agreement, and shall not engage in any behavior that violates this Agreement or affects the normal operation of the services.
• Legitimate Use of Services: You shall use MusixAI and its services for legitimate purposes only, and shall not use the services to generate, spread, or store any illegal, inappropriate, or infringing content. This includes but is not limited to content that violates public order and good customs, infringes on the intellectual property rights of others, slanders others, or contains vulgar, violent, or harmful information.
• Proper Use of Customization Features: When using the voice customization feature, you shall only use your own voice or voice samples that you have the right to use. You shall not record or upload the voice of others without authorization, or use voice samples that infringe on the rights of others. We will not be liable for any disputes or losses caused by your improper use of voice samples.
• Protect Your Device and Information: You shall be responsible for the security of your own device, and shall not allow others to use MusixAI on your device without your permission to avoid any loss of your works or related information. You shall also properly keep the works you have generated and downloaded, and we will not be liable for any loss of works caused by your improper operation or device failure.
• Comply with Copyright and Platform Rules: You shall comply with relevant copyright regulations and platform rules when using the services. The original music generated by you through MusixAI shall be used in accordance with the copyright provisions of the app: free users shall only use the generated music for personal non-commercial purposes, while premium paid users shall have the right to use the generated music for commercial purposes within the scope permitted by the app. You shall not use the generated music to infringe on the copyright of others, nor shall you resell, distribute, or authorize others to use the generated music without permission.
• Do Not Interfere with Service Operation: You shall not use any technical means to interfere with the normal operation of MusixAI, including but not limited to modifying the app's code, using plug-ins or third-party tools to obtain improper benefits, or launching attacks on the app's servers. Any behavior that affects the service stability or the user experience of others is prohibited.

4. Our Rights and Obligations

4.1 Our Rights

• Right to Provide and Adjust Services: We have the right to provide MusixAI and its related services according to the provisions of this Agreement, and to adjust the content, scope, and limitations of the services according to technological development, user needs, and operation conditions. We will notify you of any major adjustments through in-app prompts.
• Right to Manage User Behavior: If you violate this Agreement or engage in illegal, inappropriate, or infringing behavior when using the services, we have the right to take corresponding measures, including but not limited to restricting your use of the services, deleting your illegal or inappropriate works, and even terminating your right to use the services. We will not be liable for any losses caused by your violation of the Agreement.
• Right to Collect and Use Non-Personal Information: As stipulated in the MusixAI Privacy Policy, we have the right to collect non-personal information (such as device information, usage data, technical logs) during your use of the services to ensure service stability and optimize user experience. We will never collect personal identification information from you, and will never share any of your user data with any third-party AI services for any purpose.
• Right to Update the Agreement: We have the right to update this Agreement from time to time according to the changes in services and relevant regulations. When we make significant changes to the Agreement, we will notify you through in-app prompts. Your continued use of MusixAI after the changes take effect will constitute your acceptance of the updated Agreement.

4.2 Our Obligations

• Provide Stable Services: We will make every effort to ensure the stable operation of MusixAI and its services, and take technical measures to avoid service interruptions, crashes, or data loss. If a service failure occurs, we will repair it in a timely manner and notify you of the progress if necessary.
• Protect User Information: We will strictly abide by the MusixAI Privacy Policy, protect the information you provide or generate during use (including text descriptions, voice samples, generated works, etc.), and take multiple security measures to prevent unauthorized access, modification, or leakage of your information. We will never share your personal information with any third party without your explicit consent.
• Provide After-Sales Support: We will provide after-sales support for the services we provide, including answering your questions about the app's use, handling problems related to in-app purchases, and resolving technical issues you encounter. You can contact us through the designated email address if you have any needs.
• Clarify Service Rules: We will clearly display the service rules, including the scope of free and premium services, in-app purchase prices and validity periods, service limitations, and copyright provisions, so that you can clearly understand before using the services. We will not hide any key service rules or mislead you into using the services.

5. Copyright and Intellectual Property Rights

5.1 Intellectual Property Rights of the App

MusixAI, including but not limited to the app's code, interface design, logo, text, images, and AI generation algorithm, is owned by us, and all related intellectual property rights (including copyright, trademark right, patent right, etc.) belong to us. You shall not copy, modify, distribute, resell, or reverse engineer the app or its related intellectual property rights without our explicit authorization. Any unauthorized use of our intellectual property rights will constitute an infringement, and we have the right to pursue your legal liability.

5.2 Copyright of Generated Works

The original music generated by you through MusixAI is created based on your text descriptions and customization settings, and the copyright of the works shall be handled in accordance with the following rules:

• Free Users: The copyright of the music works generated by free users belongs to you, but you can only use the works for personal non-commercial purposes (such as personal listening, non-profit sharing with friends). You shall not use the works for commercial purposes (such as commercial advertising, music distribution, copyright sales) without purchasing premium services, otherwise you will be liable for corresponding violations.
• Premium Paid Users: During the validity period of your premium service, you have the right to use the music works generated by you for commercial purposes (such as commercial advertising, short video soundtrack, music platform distribution, etc.) in addition to personal use, and you shall bear the corresponding responsibilities for the commercial use of the works. You shall ensure that the works do not infringe on the intellectual property rights of others, and we will not be liable for any disputes caused by your commercial use of the works.

We reserve the right to use the anonymized and de-identified generated works (excluding any information that can be associated with you) for the optimization of the AI generation algorithm and service improvement, without obtaining your additional consent. This will not affect your ownership and use rights of the works.

6. In-App Purchase Terms

6.1 Purchase Process

When you purchase premium services through MusixAI, you need to select the desired premium service package on the in-app purchase page, confirm the purchase information, and complete the payment through the designated third-party payment platform. After the payment is successful, the system will automatically activate the corresponding premium services for you, and you can view the purchase records and service validity period in the app's "My Purchases" section.

6.2 Payment and Refund

The payment amount of the premium services is subject to the price displayed on the in-app purchase page at the time of purchase. The payment platform will charge the corresponding fees according to the purchase amount, and we will not collect any additional fees except for the displayed price. For refund requests, we will handle them in accordance with the refund rules of the third-party payment platform and the app store (such as Apple App Store, Google Play). Generally, refunds will only be provided in cases of payment failure, service activation failure, or other situations caused by our reasons. If you request a refund due to your own reasons (such as wrong purchase, no longer needing the service), we will not provide a refund, please carefully confirm the purchase information before payment.

6.3 Service Validity Period

The validity period of the premium services will be displayed on the in-app purchase page (such as monthly, quarterly, annual). The service validity period starts from the date of successful payment, and will automatically expire after the validity period ends. If you want to continue using the premium services, you need to renew the purchase before the expiration. We will send you a renewal reminder before the service expires, but we will not be liable for any loss caused by your failure to renew in time.

7. Termination of Services

7.1 Termination by You

You can terminate the use of MusixAI and its services at any time by uninstalling the app. After termination, you will no longer be able to use the app's online services (such as music generation, cloud storage of works, etc.), but the works you have downloaded to your local device will be retained. We will not be liable for any loss caused by your termination of use.

7.2 Termination by Us

We may terminate the provision of services to you in the following circumstances:

• You seriously violate this Agreement, and we have reminded you to correct it but you still do not correct it;
• You use the services for illegal purposes, or engage in behavior that infringes on the rights of others or affects the normal operation of the services;
• Due to force majeure, technical failure, or other reasons beyond our control, we are unable to provide services normally for a long time;
• We decide to terminate the operation of MusixAI or related services, in which case we will notify you in advance through in-app prompts or other appropriate methods, and handle the relevant aftermath (such as refunding the unused part of the premium service fees).

8. Dispute Resolution

If you have any disputes or disagreements with us regarding the use of MusixAI and its services, you should first try to resolve them through friendly negotiation. If the negotiation fails, you can contact us through the designated email address, and we will work with you to resolve the issue in a timely manner. We will handle your disputes and feedback seriously and fairly, and do our best to protect your legitimate rights and interests.

9. Changes to the Agreement

As MusixAI continues to develop and improve, we may update this Agreement from time to time to reflect changes in our services, user needs, and related regulations. When we make significant changes to the Agreement (such as changes to the scope of services, rights and obligations of both parties, or in-app purchase rules), we will notify you through in-app pop-up notifications or in-app messages. You can view the latest version of the Agreement at any time through the "User Agreement" section in the app's settings.

Your continued use of MusixAI after the changes to the Agreement take effect will be deemed as your acceptance of the updated Agreement. If you do not agree to the updated Agreement, please stop using MusixAI immediately.
